1. Introduction

These Terms of Service govern the use of this website and the purchase of products from Element Agri LP ("Element Agri", "we", "our", or "us").

By accessing our website or purchasing products from us, you agree to these Terms of Service.

2. Products

Element Agri supplies agricultural and livestock mineral products throughout New Zealand.

All product information, descriptions, application rates and recommendations are provided in good faith. Results may vary depending on factors including soil type, climate, management practices, livestock health, pasture species and existing nutrient levels.

Customers are responsible for determining whether products are suitable for their intended use.

3. Orders

All orders are subject to acceptance by Element Agri LP.

We reserve the right to refuse, cancel or limit any order at our discretion, including where:

• Product is unavailable.
• Pricing errors have occurred.
• Fraudulent or suspicious activity is identified.
• Shipping to the requested location is not possible.

4. Pricing

All prices displayed on our website are in New Zealand Dollars (NZD).

Unless otherwise stated, prices include GST where applicable.

Freight charges are calculated separately and displayed at checkout.

We reserve the right to change pricing without notice.

5. Payment

Payment must be received in full before products are dispatched unless alternative credit arrangements have been approved by Element Agri LP.

We accept payment through approved payment providers displayed at checkout.

6. Shipping and Delivery

We will make reasonable efforts to dispatch orders promptly.

Delivery timeframes are estimates only and are not guaranteed.

Element Agri LP is not liable for delays caused by freight providers, weather events, strikes, natural disasters or other circumstances beyond our control.

Risk in the goods passes to the customer upon delivery.

7. Product Use

Customers must follow all product labels, application guidelines and safety recommendations.

Element Agri LP accepts no responsibility for losses resulting from incorrect storage, handling, application or use of products.

8. Limitation of Liability

To the maximum extent permitted by New Zealand law, Element Agri LP shall not be liable for any indirect, consequential, special or incidental loss, including:

• Loss of profit
• Loss of production
• Loss of livestock performance
• Loss of crop or pasture yield
• Business interruption

Our total liability shall not exceed the purchase price of the product supplied.

Nothing in these Terms limits any rights available under the Consumer Guarantees Act 1993 where applicable.

9. Commercial Purchasers

Where products are acquired for business purposes, the parties agree that the Consumer Guarantees Act 1993 shall not apply to the extent permitted by law.

10. Intellectual Property

All content on this website, including logos, graphics, text and product information, remains the property of Element Agri LP and may not be reproduced without written permission.

11. Privacy

Any personal information collected through our website will be handled in accordance with our Privacy Policy and applicable New Zealand privacy legislation.

12. Governing Law

These Terms are governed by the laws of New Zealand.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the New Zealand courts.
